Successful Application To Stay Proceedings As An Abuse Of Process

Holly Nelson, instructed by Chloe Fenwick of Forbes Solicitors, represented LE, a man charged with burglary at Preston Crown Court.

Following the service of detailed skeleton arguments, and oral submissions, an application to stay the proceedings as an abuse of process was granted by the Court which brought the proceedings to a determinative end.

The Court agreed with the defence team’s submissions that the failures in the disclosure process, and a failure by the police to obtain and retain exhibits, meant that LE could receive a fair trial.
