Matthew Howarth secures fair sentence in Environmental Prosecution
At Manchester Magistrates Court, on Thursday 25th January 2018, Matthew secured a favourable sentence by way of mitigation for a Director of a Fast Food Restaurant charged with section 34 (1) (b) of the Environmental Protection Act 1990.
Following a negotiation with a representative from the Council, agreement was reached that the company charges would be withdrawn and Company Director would plead guilty on a negligent basis. Matthew persuaded the court to place the offence into Category 4 of the new Environmental Sentencing Guidelines. As a result the Court passed a sentence of a Band C fine.
Matthew observed Dan Thomas on a number of environmental prosecutions during his pupillage. He has presented a number of mock trials for Local Authorities on how to prosecute Environmental Offences. In addition, Matthew sat his law finals on Environmental Law at Newcastle University and is available to assist on a wide range of matters from Chambers.
