Rebecca Filletti & Michael Sophocleous Successful in Defending SIA Prosecution
Rebecca Filletti was instructed by Michael Sophocleous at Stokoe Partnership to represent a defendant facing prosecution by the Security Industry Authority.
The defendant initially faced allegations of supplying unlicensed security operatives contrary to section 5 of the Private Security Industry Act 2001 however, following submission of an application to dismiss on behalf of the defendant, the prosecuting authority withdrew this count and a not guilty verdict was entered.
After the defence team doggedly pursued a number of disclosure requests it became apparent that there were significant failings in the disclosure process. The prosecuting authority therefore offered no evidence on the second day of trial in relation to the remaining allegations of using a false instrument, contrary to the Forgery and Counterfeiting Act 1981 (allegations relating to security operative training documents).
