Success in Crown Court Dangerous Driving Trial For Darren Finnegan & Frank Rogers Law
Darren Finnegan, instructed by Frank Rogers, has been successful in another driving offence trial at Liverpool Crown Court.
It was alleged that the defendant had driven at speed, tailgated, weaving between lanes, undertaking cars and breaking a red light such that lives were put at risk.
The only witnesses to this were two undercover police officers whom the defendant had passed on a dual carriageway.
Through his skillful cross-examination of one of the police officers, based on material identified following detailed analysis of the unused material, Darren demonstrated that the police officer had deliberately lied about a key issue in his witness statement; lies which were perpetuated in his evidence at trial.
The jury took around 20 minutes in deliberation, before returning a unanimous Not Guilty verdict. Darren also applied for and was granted costs on behalf of his client.
Another feature of the case was the acceptability of passing a vehicle in the inside lane sometimes referred to as ‘undertaking’. The jury were referred to the relevant parts of the Highway Code by Darren and, even though the defendant admitted to passing the police on their inside, the jury found him not guilty.
