Tom Worsfold, instructed by Urfan Mahmood of Shafi Solicitors, defends gunman charged with joint enterprise attack on family home.

Tom Worsfold recently defended TF, who was charged with aggravated burglary and wounding with intent. The case concerned a joint enterprise attack with weapons on a family in their home and the discharge of an imitation firearm by TF. TF was subsequently sought by the police for a significant period, before being apprehended.

Tom conducted a close analysis of the principles of joint enterprise liability with various different factual scenarios to consider, and the section 28 cross-examination of young complainants. After careful negotiations on the day of trial, the Crown accepted TF’s pleas to wounding with intent, possession of an imitation firearm with intent to cause fear of violence and assault occasioning actual bodily harm on a basis of plea.

Before sentence, Tom worked closely with Urfan Mahmood, Director of Shafi Solicitors, to identify key documents for the judge to consider and to prepare the strongest mitigation. TF ultimately received a total sentence of 7 years’ custody, almost 18 months shorter than that imposed on his brother for the same incident.
